Rental agreement renewal

Did you know that according to the Chicago, Residential Landlord and Tenant Ordinance (commonly known as RLTO), a landlord must provide a tenant with at least 30 days written notice that the rental agreement will not be renewed? If the landlord fails to give the required written notice, the tenant may remain in the dwelling for 60 days under the same terms and conditions as the last month of the existing agreement.

It also should be noted that a landlord shall not require a tenant to renew an agreement more than 90 days before the existing agreement terminates.

Don't ignore the "RLTO"

Landlords, ignoring the Chicago Residential Landlord Tenant Ordinance (also known as the “RLTO”) could mean the difference between being sued and not being sued. 

The RLTO applies to all landlord-tenant relationships EXCEPT when the building is BOTH owner-occupied AND six or fewer units.  “Owner occupied” generally means living there full time.  If you have a problem with a tenant, consult the ordinance BEFORE acting.

Don't wait to start the eviction process

Don't wait 2 or 3 months before starting the eviction process. Very rarely does a tenant "catch up" on their rent. Act sooner than later because the eviction process takes a while. The longer you wait to call an Attorney, the more rent money you will end up losing.

Landlords, what happens if a tenant fails to pay their rent on time?

If the property is in Chicago, the Chicago Residential Landlord Tenant Ordinance mandates that you may charge a late fee of $10.00 per month for the first $500.00 in monthly rent plus five percent per month for any amount in excess of $500.00. Nothing more!

For example for a $450.00 monthly rent, the late fee is $10.00. For a $700.00 monthly rent, the late fee is $10.00 plus 5% of $200.00, $10.00 for a total of $20.00.

The City of Chicago has very tenant-friendly laws so landlords should always be friendly to their tenants and be responsive to their needs.  Think of them as business partners and always consult the ordinance before acting. Basic maintenance of your property

Maintenance performed on a regular and scheduled basis may help prevent potential breakdowns and/or malfunctions. Beyond maintenance for operational sake, the primary reason for checking, inspecting, and constantly tuning up your property is to ensure maximum safety. As a Landlord it is in your best interest to provide basic upkeep of your rental property.  This may include but not be limited to:

  • Perform an annual test of all smoke and carbon monoxide detectors.
  • Make sure that light bulb sizes do not exceed the maximum wattage label found on light fixtures.
  • Clean and/or replace furnace filters as manufacturer recommended. Service heating and cooling systems annually.
  • Test the water-heater pressure and temperature-relief valve for proper operation and drain settlement off the water heater every 6 months.
  • Install a lint trap on the washing machine drain and change regularly.
  • Prune trees and shrubs.
  • Take a walk around your property every now and then to make sure everything is in good condition.
  • Test the auto-reverse safety feature on garage-door openers.
