Landlord Remedies

According to the Chicago Residential Landlord and Tenant Ordinance (commonly known as RLTO):
  • If a tenant fails to pay rent, the landlord, after giving five days written notice to the tenant, may terminate the rental agreement. 
  • It the landlord accepts the rent after the expiration of the time period set forth in a termination notice knowing that there is a default in payment, the tenant may stay.
  • If the tenant fails to comply with the Chicago Municipal Code or the rental agreement, the landlord, after giving 10 days written notice to the tenant, may terminate the rental agreement if the tenant fails to correct the violation.
  • If the tenant fails to comply with the Code or the rental agreement, the landlord may request in writing that the tenant comply as promptly as conditions permit in the case of emergency, or within 14 days. If the breach is not corrected in the time period specified, the landlord may enter the dwelling unit and have the necessary work done. In this case the tenant shall be responsible for all cost repairs.

Chicago Security Deposit..more information you should know

On  January 14, 2014, I published a blog titled "Chicago Security Deposits...Did you know?" Here is some additional information for Landlords regarding this subject:
  • Before expenses for damages can be deducted from the security deposit, a landlord must provide the tenant with an itemized statement of the damages within 30 days of the date the tenant vacates the dwelling unit. 
  • A landlord must return all security deposits and required interest, if any, minus unpaid rent and expenses for damages, within 45 days from the date the tenant vacates the unit.
  • In the event of a fire, a landlord must return all security deposits and required interest, if any, minus unpaid rent and expenses for damages, within seven days from the date that the tenant provides notice of termination of the rental agreement.
  • In the event of a sale or any other disposition of residential real property by a landlord, the successor landlord is liable to the tenant for any security deposit or prepaid rent paid to the original landlord. The successor landlord must notify the tenant, in writing, within 14 days from the disposition that the deposit or prepaid rent was transferred to the successor landlord. The original landlord remains liable for the deposit or prepaid rent until the original landlord transfers the deposit or prepaid rent to the successor landlord and provides proper notice of such transfer to the tenant.
  • Subject to correcting a deficient amount of interest paid to a tenant on a security deposit if a landlord fails to comply with specified security deposit requirements, the tenant shall be awarded damages in an amount equal to two times the security deposit plus interest.

Chicago's Foreclosed Rental Property Ordinance

Are you considering buying a foreclosed rental property located in Chicago? If so, you need to know about the amendment to the Chicago Municipal Code that went into effect on September 24, 2013.

The City of Chicago enacted the Protecting Tenants in Foreclosed Rental Property Ordinance, commonly known as the Keep Chicago Renting Ordinance (KCRO). It requires banks to either allow renters in good standing and who pay their rent to stay in their homes; or requires that they pay tenants relocation funds of $10,600 to leave the building to enable an easier transition from their housing. This also standardizes the “cash for keys” process. If an owner fails to comply, penalties apply, the qualified tenant shall be awarded damages in an amount equal to two times the relocation assistance fee.

The Ordinance applies to any person who acquires ownership of a property pursuant to a judicial sale of a foreclosed rental property, after the sale has been confirmed by the court and any special right of redemption has expired; or mortgagees that acquire ownership of a property through foreclosure or a deed in lieu of foreclosure.

Porches, decks, balconies and stairs

On May 9, 2014, after a historic winter in Chicago, the Department of Buildings is reminding residents to take time this spring to inspect porches, decks, balconies and stairs for needed repairs and to always use porches safely during the warm summer months.

"With the extreme winter weather we've just experienced, property owners need to be mindful of building maintenance, including checking porches for any wear and tear and immediately addressing unsafe conditions,” said Buildings Commissioner Felicia Davis. She advises that porch safety does not end with an inspection, and reminds residents to properly use porches during the summer and limit the number of people on these structures. Residents should check for important signs of deterioration, including:

•    Split or rotting wood, or evidence of water damage
•    Loose, missing or rusting hardware or bolts
•    Loose or missing anchors where the porch attaches to a building
•    Missing, damaged or loose support beams and planking
•    Excessive movement of the structure when walked on
•    Wobbly handrails or guardrails
