Tenant screening is crucial for every landlord, particularly in this age of identity theft and scammers. Criminals often move about frequently, especially if running from an active warrant for their arrest or if conducting illegal activities such as selling drugs or conducting prostitution or other illicit activities on the property. With a criminal history report you can quickly and easily determine whether you need to rule out an applicant due to any brushes with the law.

The social security number fraud check is an essential component of every landlord’s tenant screening checks because applicants committing fraud may give you the social security number of a relative or friend or just make up a social security number to keep you from knowing their true identity. It is also imperative that you conduct the social security fraud alert check, as well as every other tenant screening check on every adult applicant, not just the primary applicant.

Never allow a rental applicant to avoid including the name and relevant information on every adult who will live in the household. This includes not only a spouse, boyfriend or girlfriend, but also adult children, parent or siblings and even a friend. This is because applicants often scheme to avoid including information on other adults to prevent landlords from discovering that adults other than the primary applicant have a history of evictions, a criminal history that may include currently hiding from probation or parole violations or failure to appear to answer to criminal charges. By failing to include every adult applicant on the rental application form, you could even potentially unknowingly have a sex offender living in your rental property. Why is very important to have a lease?

Knowing where to find tenants is one of the trickiest parts of getting your property rented.  Potential tenants need to know that you have a vacancy available. Since people look for rentals in all different places, It's very important that you advertise your property in a variety of locations as well.

10-Day Notice: Violation of Lease or Rental Agreement

Landlords, if your tenant violates the lease or rental agreement, you must give them a 10-day notice to correct the issue. The notice must specify exactly what the tenant has done wrong and allow them ten days to correct it.

For example, you can use the 10-Day Notice if your tenant gets a dog and the lease says no pets. If your tenant gets rid of the dog within 10 days, you cannot evict them. However, if the tenant keeps the dog, you have the right to file a lawsuit and proceed with the eviction.

Payments made during the 5 day notice

If, within 5 days of giving the non payment of rent notice, the tenant pays the entire amount of rent due, you must accept it. You will not be able to proceed with the eviction.

If your tenant wants to make a partial payment of the rent demanded in the 5-Day Notice, you can deny acceptance and continue with the eviction.

If you accept the partial payment, you waive your right to terminate the lease. To protect yourself, make sure your notice clearly states that partial payment does not waive your right to terminate the lease.

5-Day Notice: Failure to Pay Rent

Landlords, if your tenant is behind in the rent, you must give them five days to bring the rent up to date. A 5-day notice must be served and  must state the tenant’s name, a description of the rental unit, the exact amount of rent due, and the date by which the tenant must pay the back rent.

The due date stated in the notice must be five days from the date the tenant is served with the notice. Even one day short and the notice is not good. For example, if you serve the tenant with the 5-Day Notice on September 5, the tenant must have at least through September 10 to pay you. The day that you serve the tenant with the notice does not count as one of the five days.

You must be available to receive payment during the five days. And, the notice must also state that if full payment is not received by the date specified, the lease is terminated. You may only demand rent that is actually due at the time of the notice.

How Do You Evict a Tenant?

If you have a written lease, you cannot evict someone just because you have changed your mind, and simply do not want them living in your property. They must have done something wrong, such as violating some rule or term in the lease or not paying the rent. There are five basic eviction steps for getting your unwanted tenant out:
  1. Notice-You must serve the tenant with proper written notice of your intent to terminate the lease and why.
  2. Lawsuit-If the tenant fails to correct the violation or pay the past due rent, you must file a lawsuit and have the Sheriff give notice to the tenants.
  3. Court Hearing-You must go to court and prove to a judge or a jury that you have used the correct notice, that the lease has been properly terminated, and that you have a right to possession of the property.
  4. Order for Possession-If you win your case, you will get a written Order for Possession from the court. The Order may also include a judgment for past due rent, court costs, and attorney’s fees. It may also give the tenant time to move before the actual eviction takes place.
  5. Eviction-The actual eviction takes place when you place the Order for Possession with the Sheriff who will go out and forcibly remove the tenant from your property.

Landlords, under no circumstances can you...

...evict a tenant yourself. If you unlawfully change the locks, cut off utilities or take any steps to evict a tenant yourself, you can be fined. The eviction process is set by Illinois law. You must follow the law exactly or you will lose your case.

It does not hurt to try to negotiate your tenant out of the unit. This requires that you and your tenant are both reasonable and can reach an agreement. If an agreement is not possible, and you want the tenant out, you will have to follow the eviction process.

Illinois evictions

In Illinois, a landlord can evict a tenant for a number of reasons, including not paying rent or violating a portion of the rental or lease agreement. Evictions in Illinois are regulated by the Illinois Code of Civil Procedure, and landlords must carefully follow these procedures in order to evict a tenant. 

If the tenant is being evicted for not paying rent on time, the landlord must give the tenant five days' notice to pay the rent (this is called a notice to quit or notice to pay rent or quit). If the tenant does not pay the rent within the five days, then the landlord can proceed with filing an eviction lawsuit, also known as a forcible entry and detainer suit in Illinois.

If the tenant is being evicted for violating a portion of the lease or rental agreement (for example, by having a cat when no pets are allowed), then, generally speaking the landlord must give the tenant ten days' notice to move out of the rental unit. If the tenant does not move out of the rental unit within ten days, then the landlord can proceed with filing an eviction lawsuit. 

Month to month leases have a 30 day at will term of a lease. The 30 day notice must fulfill a full 30 days of rental. For example if the 30 day notice was given today, August 10th the 30 days to move out of the rental unit would be October 1st. If the tenant does not move out of the rental unit within 30 full days of rental, then the landlord can proceed with filing an eviction lawsuit.

Illinois landlords must follow the proper procedures for evicting a tenant. A landlord who does not follow the proper procedures will have to start the eviction process over from the very beginning. The tenant can use evidence that the landlord did not follow legally-required procedures as a defense. City of Chicago provides resources to help keep residents safe during extreme heat

On July 17, 2015, The Chicago Department of Public Health (CDPH) and Department of Family and Support Services (DFSS) reminded residents to be aware of extreme temperatures and to be sure to take the necessary precautions to avoid heat-related emergencies. Residents are urged to call 311 for well-being checks, and to check in on neighbors and seniors.

To Prevent Heat Related Illness:
  • Keep your body cool. Take cool showers or baths if necessary.
  • Stay in air conditioned buildings as much as possible. If you don’t have access to air conditioning, call 311 to find the nearest cooling center. DO NOT rely on a fan as your primary cooling source.
  • Be sure to monitor weather forecasts so you can plan your activities safely when it’s hot outside. Avoid going out in the heat during the hottest part of the day.
  • If you do go out, wear light, loose-fitting clothing---and wear a hat to protect your head. Use sunscreen and reapply as directed on the package. If you’re exercising or working outside, pace yourself and drink more water than usual and don’t wait until you are thirsty to drink more. If possible, take breaks to cool off in an air conditioned room and always have a partner with you.
  • NEVER leave infants or children in a parked car. Nor should pets be left in parked cars—they can suffer heat-related illness too.
  • Check on your relatives, friends and neighbors and share these tips with them. The elderly, those who live alone, those who are ill and young children are most vulnerable to extreme heat and humidity.
Resources Available to Keep Safe and Cool:
  • DFSS coordinates the operation of cooling centers, provides transportation to them and conducts well-being checks on at-risk residents, including seniors.
  • The Garfield Center, located at 10 S. Kedzie, is available 24 hours a day, seven days a week to connect residents to emergency shelter.
  • In addition, the King Center (4314 S Cottage Grove) and North Area Center (845 W. Wilson) will be open as cooling centers from 10:00 a.m. to 5:00 p.m.
  • Additional city facilities including libraries, police stations or other structures might be made available after hours, on weekends, or on holidays, as conditions warrant.
  • Seniors or individuals with limited mobility may call 311 to request transport to the nearest cooling center.

Landlords, what can you do...

...if your tenant is not keeping up his end of the bargain and has violated the lease?

First, I would try to talk to the tenant to see if you can reach an agreement. Sometimes a tenant has a valid reason for falling a little behind in the rent  or, they may not understand that certain behavior is in violation of the lease. If you and your tenant can come to an understanding, you may be able to avoid an eviction.

If an agreement cannot be reached, then I would suggest that you send a letter advising the tenant that you expect either the lease or the conditions you set in a month-to-month tenancy, to be followed exactly. A formal written notice explaining the terms is helpful and gives the tenant a chance to follow the terms.

Make sure that any new agreement, whether temporary or permanent, is written down, dated and signed by both you and the tenant(s). Oral agreements cannot be enforced in court. Be sure to give the tenant a copy of the signed agreement and keep a copy for yourself.

Part 3: Credit reports

If a credit report provides negative information about a prospective tenant and you decide not to rent to them because of their bad credit, the Fair Credit Reporting Act requires you to take certain steps. An "Adverse Action" letter must be mailed to the applicant explaining that you have declined their application because of their credit report. You must include the exact reasons for your rejection and provide them with the name, address and phone number of the agency you used to run the credit report. They have the right to request a free copy of their credit report from the agency within 60 days.

Landlords be sure to include ...

...any late fees in the Lease. This important information should be in writing and be specific, It should say exactly how much you will be charging and should include a statement that the penalties are not negotiable. Stick to the agreement and never waive a penalty as this may weaken your standing with your tenant and set a bad precedent. If you waive it once they will assume you'll waive it again.

What is the 5 day Eviction Notice?

The 5 Day Eviction Notice is given to a tenant for nonpayment of rent only. It is not used for any other tenant violation. What to do when good tenants are late with the rent

Anyone can have a temporary financial setback or make errors in a checkbook. A good tenant will notify you of a late payment before the rent is due. If you want, you can make an exception for a late payment from a long-term tenant who has consistently paid on time. If you decide to give your tenant a grace period, it's best not to go beyond three to five days. You do however, need to be careful that you do not violate fair housing laws by establishing preferential treatment.

If needed, a catch-up payment schedule might need to be worked out to move the due date back a week or two. Be sure to put your agreement in writing and keep track of the payments. If they meet the scheduled due date on time, you have nothing to worry about. If not, your only option is to start the eviction process by giving them a Pay Rent or Quit notice or Unconditional Quit notice with specific dates for leaving.

Know your town's laws

Depending on the laws of your town, you may have to have a unit inspected before a tenant can move in. This inspection is done so the town can issue you a Certificate of Habitability. Some towns do not require this, some only require this inspection the first time the unit is rented, some every five years and others every time a new tenant moves into the unit. Also, if you are renting to a Section 8 tenant, they have their own rules for inspections.

Landlords, go over the lease with your tenant

Once you have conducted the proper tenant screening and have chosen a tenant for your rental, it is advisable to go over the lease agreement with the tenant section by section so that they completely understand what they are agreeing to.

Raising the rent

The primary reason for raising rent is the increased cost of running your business. Everything should be taken into account, utilities, insurance, taxes, maintenance and repairs. If the rent on your property has been stable for quite some time, you may want to raise the rent to stay competitive, pay your bills and to hopefully make some money for your labor. And, if you have substantially increased the value of the property by making significant improvements, that, too, calls for raising the rent.

With a longtime tenant it's best to be honest about why an increase is necessary. Explain to them why an increase is needed and although you hate to raise the rent you decided that you must. Stress the fact that you want to provide the best environment you can for them. If they seem upset, explain that you've already cut costs as much as you can and this is the only option you have left to meet your expenses. If true, emphasize that fact that you haven't had an increase for quite a while, telling them exactly when the last raise in rent was and explain that you can no longer ignore increasing the rent. 

Your tenant might not like the increase, but after thinking about the cost of moving to another place and finding out that similar apartments are in the same price range, most likely they will stay.

In general, rent increases range from about 4 to 6 percent. Some landlords on the high side would go up to 10 percent. Let the market in your area be your guide and be reasonable with the increase so your tenant does not feel you are price gouging or being greedy. Instead of periodically raising the rent, you might want to try set annual increases of 1 or 2 percent a year which you write into the lease. 

When contemplating raising rent, you should also consider what it will cost you to advertise, screen, and prepare for a new tenant should yours decide to move.
