Landlords, check for Space Heaters

As the winter chill takes hold, the City of Chicago reminds residents to take precautions during the cold weather. The Chicago Fire Department (CFD) does not recommended using space heaters; however, if used, be sure they are UL certified and at least 3 feet from anything that can ignite.  Use of a space heater in children’s rooms should be monitored closely as children sometimes move them close to or into the bed with tragic results.  If extension cords are used, they should be rated at 15 amps minimum and never put cords under carpet.

With the added demand on furnaces and boilers, CFD also reminds residents are required by ordinance to have working carbon monoxide detectors to protect against carbon monoxide leaks from a heating system that could be fatal over time.

The Chicago Heat Ordinance

The Chicago Heat Ordinance mandates that landlords supply heat to rental units during cold weather months.  From September 15 to June 1, the temperature inside a rental residence must be at least 68 degrees during the day.  During the evening, the temperatures must be at least 66 degrees.  The Department of Buildings encourages residents to first contact their landlords when these temperatures are not maintained and to call 3-1-1 if no action is being taken.  During extreme cold weather, however, the Building Department’s first priority is responding to heat complaints and it reassigns inspectors to handle the increased number of heat complaints.

  • Winter proof homes by covering windows with plastic sheeting, applying weather stripping around doors, insulating hot water pipes and installing programmable thermostats.  These weatherization measures are important tools during the heating season to help manage energy costs.
  • Have appliances serviced by qualified contractor.  Keep heating, ventilation and metering equipment free from debris, snow and ice. Ensure natural gas appliances are correctly flued and have the correct ventilation to avoid carbon monoxide build up in living areas. Check/Install carbon monoxide detectors.

Check your pipes now

On November 15, 2014, the City of Chicago released information to residents reminding them to be cognizant of weather conditions, heed the warnings given by experts, recognize the implications of wind chill advisories, winter storm watches and warnings. Residents should know the signs and care of frostbite and hypothermia.  Winter preparation information is available at www.alertchicago.com including links to other local, state and federal resources.

The Chicago Department of Water Management (DWM) encourages residents to act now to make sure pipes in homes are properly insulated and not exposed to freezing air.  This includes pipes in garages and unheated areas of the home. If pipes do freeze, do not use candles or any open flame to thaw them.  Use a hair dryer or heating pad.

What is the Forcible Entry and Detainer Section?

The Forcible Entry and Detainer Section of the Circuit Court of Cook County is a section within the First Municipal District. Because the Forcible Entry and Detainer Section hears cases that seek evictions from real estate premises, the section is commonly known as “Eviction Court.”

In the most frequently filed actions, litigants are seeking evictions to obtain one of the following results:
  • Possession of property (known as a “single action”);
  • Back rent and possession of property (known as a “joint action”); or
  • Condominium fees such as assessments and other fines.
There are other cases heard in the Forcible Entry and Detainer Section also.  These include:
  • lock-out cases, where landlords attempt to bypass proper eviction procedures and instead change the locks on the door or shut off utility services; and
  • distress for rent cases, where landlords seize tenants’ personal property to secure payment of past due rent.

Lead Poisoning

On October 24, 2014, in honor of National Lead Poisoning Prevention Week, the Chicago Department of Public Health (CDPH) launched a new public education campaign urging residents to get their children and homes tested for lead.

The campaign urges homeowners and property owners of pre-1978 homes to get their homes tested for lead-based paint hazards and targets neighborhoods with the highest incidents.

“Every day, the City of Chicago works to ensure children are tested for lead, parents and property owners are aware of the dangers of lead and city and state laws are enforced to protect all residents,” said Mayor Emanue.  The City, along with Neighborhood Housing Services, will address lead hazards in 234 housing units and will assess and repair other identified hazards, providing safer homes for low- and very low-income families with children.

Repair and deduct remedy?

This is the tenant's way of deducting the amount necessary from the rent to repair defects covered by the implied warranty of habitability. Important public safety ordinance

On October 8, 2014, Mayor Emanuel and Aldermen Burke, Balcer and Solis introduced an important public safety ordinance that repeals a dangerous post-citation compliance defense for residential landlords who forego the installation of smoke detectors and carbon monoxide detectors.

Earlier this month, four children tragically lost their lives in a residential fire in which there were no working smoke detectors,” said Mayor Emanuel. “The law as written provides no incentive for landlords to install smoke and carbon monoxide detectors in their units, as they can comply after they are ticketed to avoid a fine. There is no excuse for landlords who seek to avoid the minimal cost and labor to install smoke and carbon monoxide detectors, and this proposed ordinance will strengthen the laws we have to enforce these important public safety provisions.”

The proposed ordinance amends the building code for smoke and carbon monoxide detectors to hold residential landlords accountable by eliminating the defense and creating a daily fine range for these specific life threatening violations. The ordinance would specifically repeal post-citation compliance as an affirmative defense to violations relating to smoke detectors and carbon monoxide detectors and increased the daily minimum fine from $300 per day to $500 per day and sets the maximum fine at $1,000 per day.

Carbon Monoxide Detectors

Carbon monoxide is a colorless, odorless, and highly toxic gas that is produced through the incomplete combustion of fuels from things like kerosene space heaters, furnaces, gas  and wood stoves, fireplaces, water heaters, gas dryers and auto exhaust fumes.

The end of Daylight Savings Time on November 2nd is an ideal time to replace smoke alarm and carbon monoxide detector batteries. The owner of the building must install detectors where required and provide tenants with written information regarding testing and maintenance. The tenant is responsible for maintaining and testing the detector. If the detector is battery operated, the tenant is responsible for changing batteries.

City of Chicago's 11th Annual Rents Right Expo

The 11th Annual Rents Right Expo will provide a convenient, one-stop opportunity to get important information on the various aspects of rental housing from 9 a.m. to 2 p.m., Saturday Oct. 18 at McFetridge Sports Center, 3843 N. Are your smoke alarms in working condition?

The City of Chicago, Department of Buildings along with the Fire Department are reminding residents that working smoke alarms save lives. It is important that all smoke alarms be tested on a monthly basis. The end of Daylight Savings Time on November 2nd is an ideal time to replace smoke alarm and carbon monoxide detector batteries.

According to the latest National Fire Protection Association research, working smoke alarms cut the chance of dying in a fire in half. Meanwhile, almost two-thirds of home fire deaths nationwide resulted from fires in homes with no smoke alarms or no working smoke alarms.

This year’s Fire Prevention campaign includes the following smoke alarm messages:
  • Install smoke alarms in every bedroom, outside each separate sleeping area and on every level of the home, including the basement.
  • Interconnect all smoke alarms throughout the home. This way, when one sounds, they all do.
  • Test alarms at least monthly by pushing the test button.
  • Replace all smoke alarms when they are 10 years old or sooner if they don’t respond properly.
  • Make sure everyone in the home knows the sound of the smoke alarm and understands what to do when they hear it.
  • A smoke alarm should be on the ceiling or high on a wall.  Keep alarms away from the kitchen to reduce false alarms.  They should be at least 10 feet away from the stove. But no more than 15 feet away from bedroom doors

What is default?

Landlords, did your tenant ask about the Small Accessible Repairs for Seniors program?

The City of Chicago offers a Small Accessible Repairs for Seniors (SARFS) program. This program provides safety, security and accessibility improvements that help senior citizens to remain in their homes. Repair types are limited to minor repairs that may include, but are not limited to:

Grab bars
Lever faucets
Door repairs
Carbon monoxide detectors
Smoke detectors
Wheelchair ramps

SARFS is for Chicago seniors who earn no more than 80 percent of the area's medium income and are at least 60 years of age. Qualified recipients may be owners or renters residing in a one to four unit building (a renter must have permission from the landlord and the landlord needs to certify that he or she will not increase the rent as a direct result of SARFS improvements).

Can a tenant stay after the expiration of a lease?

A tenant who stays after the expiration of  a lease is called a tenant at sufferance. A landlord can start the eviction process or choose to continue accepting rent either on a once a month basis or agree to renew the lease for another year. This all depends on the terms of the original lease and provisions of the law which may in some cases give the landlord the right to charge double the current rent during the withholding period. Bed Bugs!

Bed bugs are small, flat, wingless insects.  They feed on blood and can be a nuisance for individuals. They are named for their tendency to live on mattresses or other parts of a bed.  They can be found in homes, condominiums, apartments, hotels, schools, dormitories, shelters, offices and many other places.

In 2013, the City of  Chicago Council passed an ordinance to help address the problem of bed bugs. The requirements established by this ordinance follow:

Rental Housing: The ordinance established several requirements for both landlords and tenants. Among these is a requirement that landlords must provide a brochure on bed bugs to tenants when signing a new or renewing an existing lease or other rental agreement (note this does not apply to owner-occupied buildings containing six units or less). This brochure lists all of the requirements of the ordinance for both the landlords and tenants.

Condominium and Cooperative Buildings: All governing associations need to have a written plan to address bed bugs.  A sample plan was created to assist associations in developing their plans.  That sample plan is available on the city of Chicago website and lists all of the requirements of the ordinance for those who own units within condominium or cooperative buildings.  The sample plan also refers to a fact sheet that can be provided to unit owners.

Residential buildings – Heat to be furnished

According to the Municipal Code of Chicago, Chapter 13-196-410: Every family unit or rooming unit to which heat is furnished from a heating plant used in common for the purpose of heating the various rooms of the dwelling shall be supplied with heat from September 15th of each year to June 1st of the succeeding year so that the occupants of a family unit or rooming unit may secure, without such undue restriction of ventilation as to interfere with proper sanitary conditions, a minimum temperature of 68 degrees at 8:30 a.m. and thereafter until 10:30 p.m. and 66 degrees at 10:30 p.m. and thereafter until 8:30 a.m. averaged throughout the family unit or rooming unit.

Discrimination when it comes to renting

Discrimination (in renting): Denying a person housing, telling a person that housing is not available (when the housing is actually available at that time), providing housing under inferior terms, harassing a person in connection with housing accommodations, or providing segregated housing because of a person's race, color, religion, sex, sexual orientation, national origin, ancestry, source of income, age, disability, whether the person is married, or whether there are children under the age of 18 in the person's household. Discrimination also can be refusal to make reasonable accommodation for a person with a disability.

Energy Disclosure Application

Building Owners must provide the cost of monthly heating to prospective tenants prior to signing a lease. The Chicago Municipal Code requires that a building or dwelling unit owner provide a disclosure to prospective tenants if they will be responsible directly to the utility company for paying the cost of gas or electric heat for that building or unit. The property owner/landlord must also provide in writing the annual cost of heating based on the previous 12 months.

The Application for Energy Disclosure is used to request gas or electric disclosures on a particular address and/or unit number.  Separate applications are required for Gas and Electric Heat. The property owner may use the application for energy disclosure to obtain current information. The Chicago Heating Cost Disclosure Form can be found on the City of Chicago website.

Tips for choosing tenants

Landlords, it is advisable that you ask your prospective tenants to complete a rental application. Two important elements of the application are the person's employment and past rental history. Information should be provided for the past three or five years.

Once you receive a completed application, you should contact each of the applicant's employers and landlords. If the applicant has worked at the same job and lived in the same apartment for that time period, it may be a good indication of a quality tenant.

If the prospective tenant agrees, credit bureaus can supply landlords with a credit history report. This report will provide you with valuable information such as, the timeliness in which credit card and car loan payments have been made, bankruptcies, judgments against the tenant, and any other adverse information from creditors.

City of Chicago Announces Enforcement Efforts Under the Keep Chicago Renting Ordinance

Mayor Emanuel and the Department of Business Affairs and Consumer Protection (BACP) announced on August 15, 2014, that the City, in partnership with other community advocate groups, is investigating multiple complaints by residents whose tenant rights may have been violated under the Protecting Tenants in Foreclosed Rental Property Ordinance (Keep Chicago Renting Ordinance), and is calling upon banks and property managers to comply with the law.

The Keep Chicago Renting Ordinance requires the new owners of foreclosed properties to provide written notice of the change in ownership to all tenants within 21 days after becoming the new owner or within 7 days of determining the tenant’s identity. Notice must be delivered to known tenants or household members 13 years or older, or mailed. In addition, notice must be posted on the primary entrance of each foreclosed property. The new owner is also required to notify tenants of their options under the Ordinance, which include the new owner offering to renew or extend the tenant’s rental agreement for the rental amount not greater than 102% of the tenant’s current annual rent, or providing qualified tenants with $10,600 for relocation assistance. Failure to provide essential services

According to the Chicago Residential Landlord and Tenant Ordinance (commonly known as RLTO) a landlord must provide essential services. If there is material noncompliance by the landlord with the rental agreement or with Section 5-12-070, either of which constitutes an immediate danger to the health and safety of the tenant or if, contrary to the rental agreement or Section 5-12-070, the landlord fails to supply heat, running water, hot water, electricity, gas or plumbing, the tenant may give written notice to the landlord specifying the material noncompliance or failure. After such notice, the tenant may during the period of the landlord's noncompliance or failure:

(1) Procure reasonable amounts of heat, running water, hot water, electricity, gas or plumbing service, as the case may be and upon presentation to the landlord of paid receipts deduct their cost from the rent; or

(2) Recover damages based on the reduction in the fair rental value of the dwelling unit; or

(3) Procure substitute housing, in which case the tenant is excused from paying rent for the period of the landlord's noncompliance. The tenant may recover the cost of the reasonable value of the substitute housing up to an amount equal to the monthly rent for each month or portion thereof of noncompliance as prorated.

In addition to the remedies set forth in Section 5-12-110 (1) (1) — (3), the tenant may:

(4) Withhold from the monthly rent an amount that reasonably reflects the reduced value of the premises due to the material noncompliance or failure if the landlord fails to correct the condition within 24 hours after being notified by the tenant; provided, however, that no rent shall be withheld if the failure is due to the inability of the utility provider to provide service; or

(5) Terminate the rental agreement by written notice to the landlord if the material noncompliance or failure persists for more than 72 hours after the tenant has notified the landlord of the material noncompliance or failure; provided, however, that no termination shall be allowed if the failure is due to the inability of the utility provider to provide service. If the rental agreement is terminated, the landlord shall return all prepaid rent, security deposits and interest thereon in accordance with Section 5-12-080 and tenant shall deliver possession of the dwelling unit to the landlord within 30 days after the expiration of the 72 hour time period specified in the notice. If possession shall not be so delivered, then the tenant's notice shall be deemed withdrawn and the lease shall remain in full force and effect.

The tenant may not exercise his rights under this subsection if the condition was caused by the deliberate or negligent act or omission of the tenant, a member of his family or other person on the premises with his consent. Before correcting a condition, the repair of which will affect more than his own dwelling unit, the tenant shall notify all other tenants affected and shall cause the work to be done so as to result in the least practical inconvenience to other tenants.

Landlords, did you know?

According to the Chicago Residential Landlord and Tenant Ordinance (commonly known as RLTO) a landlord cannot require a tenant to renew a lease agreement more than 90 days before the existing lease agreement terminates.

A simple overview of the eviction process in Chicago

Bradford Miller Law, P.C., has extensive experience representing landlords in Chicago eviction proceedings. The following is a brief summary of the process:
  1. Proper notice is served to the tenant by the landlord or his or her agent. Typically, this is a five-day notice, which is for nonpayment of rent.
  2. After the five days have passed, the complaint and summons is filed with the court. 
  3. Before the first court date, the sheriff must serve the tenant with the complaint and summons to appear in court. If the sheriff is unsuccessful, a special process server will have to get appointed to serve the tenant. 
  4. The first court appearance occurs. This is when anything can happen. Unless there is a default judgment or the case is dismissed, there will likely be another court date.
  5. The court process will then play itself out. This could mean anything from an agreed order (which is like a settlement agreement) to a full-blown trial. Generally speaking, both parties try to settle instead of going to trial.
In the end, the landlord hopes to get an order of possession to get the property back. If the landlord sought money damages, he or she may also get a money judgment awarded. If the landlord receives an order of possession, he or she can place it with the sheriff after expiration of the "stay" to remove the tenant from the premises. Typically, a judge will grant a stay of anywhere from one to two weeks, which is intended to give time to the tenant to move out on his or her own.

Notices that landlords must give to new or renewing tenants

According to the Chicago Residential Landlord and Tenant Ordinance (commonly known as RLTO) a landlord must give new or renewing tenants notice of:
  1. Code citations issued by the City in the previous 12 months;
  2. Pending Housing Court or administrative hearing actions;
  3. Water, electrical or gas service shut-offs to the building during entire occupancy.

You must let your tenant know that you were served a forclosure complaint

According to the Chicago Residential Landlord and Tenant Ordinance (commonly known as RLTO) within seven days of being served a foreclosure complaint an owner or landlord of a premises that is the subject of the  foreclosure complaint shall disclose, in writing, to all tenants of the premises that a foreclosure action has been filed. The owner or landlord shall also notify of a foreclosure suit, in writing, before a tenant signs a lease.

Door and window screen reminder.

On July 18, 2014, after incidents this summer in which young children were severely injured or killed after falling from an open window, the Department of Buildings and the Department of Public Health are reminding residential building owners, occupants and parents to install operable window guards on windows and limit window openings to 4 inches or less.

The Chicago Building Code requires every door opening and every window to have screens in place from April 15th to November 15th of each year. Specifically, every door opening directly from any family unit to the outdoors and every window, or other outside openings used for ventilation purposes, must be supplied with a screen of not less than 16 mesh per inch and every screen door shall have a self-closing device in good working condition. Graffiti Removal Program

Did you know that the City of Chicago has a graffiti removal program? Graffiti is vandalism. It scars the community, hurts property values and diminishes our quality of life. Graffiti removal is a free service for private property owners and has become one of the most popular services offered by the City of Chicago.

The Graffiti Removal Program employs "blast" trucks that use baking soda under high water pressure to remove painted graffiti from brick, stone and other mineral surfaces. The program also deploys paint trucks to cover graffiti on surfaces such as metal or wood. The program depends on community groups, block clubs, chambers of commerce and individual residents to report graffiti and request a removal.

The Department of Street and Sanitation also works very closely with the Chicago Police Department who will apprehend graffiti vandals caught defacing property. Further information can be found on the City of Chicago website.

Did your tenant abandon the property?

Abandon means to intentionally and permanently give up, surrender, leave, desert or relinquish all interest. This is often used in situations to determine whether a tenant has left his/her apartment and the property inside and does not intend to come back. Thus, a landlord can take over an apparently abandoned residence, but must store anything a tenant leaves behind and give notice to the tenant before selling or discarding the possessions which were left.

Fire or Casualty Damage

According to the Chicago Residential Landlord and Tenant Ordinance (commonly known as RLTO) if a fire damages the unit to an extent that it is in noncompliance with the Municipal Code and the tenant, tenant's family or guests are NOT responsible for the fire or accident, the tenant may:
  1. Move out immediately, but if this is done, the tenant must provide written notice to the landlord of the intention to terminate within 14 days after moving out.
  2. The tenant may stay in the unit, if it is legal, but if the tenant stays and cannot use a portion of the unit because of damage, the rent may be reduced to reflect the reduced value of the unit.
  3. If the tenant stays, and the landlord fails to diligently carry out the work, the tenant may notify the landlord, in writing, within 14 days after the tenant becomes aware that the work is not being diligently carried out, of the tenant's intention to terminate the rental agreement and move out.

Rent to own lease/purchase

Landlords are you thinking about moving toward the sale of your property using a rent to own lease/purchase agreement?

This is a legal contract that obligates the tenant to purchase the property for an agreed-on price at the end of the lease period. A nonrefundable deposit can be applied to the down payment, and a small portion of the rent may be applied to closing costs. You must provide a written statement of damages

If you wish to deduct repair costs from a security deposit, the Chicago Residential Landlord Tenant Ordinance requires that you provide your tenant with a written statement describing the damage to your property that you believe they caused. You must list the actual and estimated costs of repair and provide receipts for the repairs. This must be done within 30 days after the tenant moves out.

If you list estimated costs, you have an additional 30 days to furnish the tenant with paid receipts. If no damages are being deducted, you are required to return the security deposit within 45 days after the tenant moves out. You do not have to send a statement if you are keeping the security deposit because rent is owed.

Thinking about renting your condo?

On November 15, 2013, Pamela Dittmer McKuen,Community Living reporter for the Chicago Tribune reported in an article titled "Associations seeking ways to accommodate renters" In part, she stated that:

"During the construction boom of the 1990s, developers levied few restrictions so as not to deter prospective buyers. They wrote governing documents that largely permitted leasing of the units.

A decade later, as associations became established, many decided to tighten the reins on non-owner occupants. They went through the detailed process of hiring attorneys to write declaration amendments that restricted or even banned renters.

Next came the real estate market crash of 2008. Owners lost jobs and home equity, and they couldn't pay their assessments or mortgages. Many went into foreclosure. When they petitioned for exceptions to rental restrictions, sympathetic associations amended their declarations again. Others tacitly allowed the rentals despite restrictions.

Today, property values remain depressed in many areas, and investors are scouting for bargains. Concerned about a possible influx of renters, associations once more are rethinking their positions toward them.

"The good news is, people who are renting condos are getting good rents," said real estate agent Connie Abels of Re/Max Edge in Chicago. "Even investors have to pay assessments. It's a much better alternative for the building to stay healthy to allow tenants, and the assessments get paid."

Identification of owner and agents.

According to the Chicago Residential Landlord Tenant Ordinance (also known as the "RLTO") a landlord or any person authorized to enter into an oral or written rental agreement on the landlord's behalf is required to disclose to the tenant in writing at or before the commencement of the tenancy the name, address, and telephone number of:

   (a)   The owner or person authorized to manage the premises; and
   (b)   A person authorized to act for and on behalf of the owner for the purpose of service of process and for the purpose of receiving and receipting for notices and demands.

The information must be kept current and extends to and is enforceable against any successor landlord, owner, or manager.  If the landlord fails to comply with this section, the tenant may terminate the rental agreement and after receipt of written notice, the tenant shall recover one month's rent or actual damages, whichever is greater.

What is discrimination when it comes to renting your property?

Discrimination when it pertains to renting your property is when you deny a person housing, telling a person that housing is not available (when the housing is actually available at that time), providing housing under inferior terms, harassing a person in connection with housing accommodations, or providing segregated housing because of a person's race, color, religion, sex, sexual orientation, national origin, ancestry, source of income, age, disability, whether the person is married, or whether there are children under the age of 18 in the person's household. Discrimination also can be refusal to make reasonable accommodation for a person with a disability.

First step in the eviction process

In the City of Chicago, before a landlord can begin the eviction process, proper notice must be given to the tenant by the landlord or their agent. Typically, for non-payment of rent, this is a "5-day notice." The notice must contain specific language per the statute and must be served properly.
